Powers of Attory (POA)

Planning for Mental Incapacity

Nobody wants to think about a time when they may not be able to make their own decisions or look after themselves, but with some careful planning you can reduce some of the uncertainty. You can make legal arrangements to appoint a trusted person to look after your best interests, even if you can't manage them for yourself. We don't know what the future holds, but I can sit down with you and help you cope and plan for mental incapacity. Expert Wills can help you make legal arrangements to make sure that there is someone you trust to make decisions on your behalf, concerning your finances and health and wellbeing. That way we can ensure your best interests are always looked after. Solicitors now charge up to £7,000 to have a deputy appointed on your behalf if Lasting Powers of Attorney are not in place, in a timely manner. This makes planning ahead the most cost-effective option.

Making a Lasting Power of Attorney

A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint someone (an attorney or attorneys) you trust to make decisions on your behalf.

This means someone will look after your affairs in the event of mental and/or physical incapacity, which could be due to old age, illness or an accident. A Lasting Power of Attorney must be made when you are fit and healthy and can cover decisions concerning your property, finances or health and welfare.

They allow you to nominate someone to look after all your legal decision-making powers. They will speak on your behalf, as if you were speaking yourself, making decisions concerning the ability to pay your bills, look after your business and make decisions regarding the care of your children.

A will looks after you affairs after you die, but LPAs look after you while you are alive, but at your most vulnerable. This means it is vital that they are set up and meet your wishes, as you will still be around to suffer the consequences if they are not arranged.
